8. Limitation of liability
8.2 Except for liability that cannot be limited by law, each party’s total liability arising out of this Agreement shall not exceed the fees paid in the three (3) twelve (12) months preceding the claim.
9. Data protection
9.1 Each party shall comply with applicable data protection laws. Where the Supplier processes personal data on behalf of the Customer, the parties shall enter into the Data Processing Agreement in Schedule 4.
14. Governing law
14.1 This Agreement is governed by the laws of England and Wales.
