Welcome to Stackmint! These Terms of Service ("Terms") govern your access to and use of the Stackmint website, applications, products, and services (collectively, the "Services"). By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.
1. Overview of Stackmint
Stackmint is a platform that enables users to create, deploy, and share AI-powered applications, workflows, and integrations ("Buds" and "Branches") from prompts.
2. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement.
3. Accounts and Security
Account creation: You must provide accurate and complete information when creating an account.
Security: You are responsible for safeguarding your account credentials and for all activities under your account.
Notification: Notify us immediately at legal@stackmint.ai if you suspect unauthorized access to your account.
4. Acceptable Use
You agree not to:
- Use the Services for any illegal or unauthorized purpose.
- Infringe on the intellectual property or rights of others.
- Upload malicious code or interfere with the operation of the Services.
- Attempt to access areas or data of the Services you are not authorized to access.
We reserve the right to suspend or terminate your account if you violate these rules.
5. User Content
Ownership: You retain ownership of any content you create or upload using the Services.
License to Stackmint: By submitting content, you grant Stackmint a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display that content solely to operate and improve the Services.
Responsibility: You are responsible for the legality, reliability, and appropriateness of your content.
6. Third-Party Services
The Services may integrate with third-party applications (e.g., Salesforce, Slack, Google Calendar). Your use of those services is governed by their own terms, and you are responsible for reviewing them.
7. Payment and Subscriptions
Fees: Some Services require payment of fees, which will be disclosed before you purchase.
Billing: By providing payment information, you authorize us (and our payment processors) to charge the applicable fees.
Cancellation: You may cancel subscriptions at any time; charges already incurred are non-refundable unless otherwise stated.
8. Intellectual Property
All rights, title, and interest in the Services (excluding your content and third-party content) are owned by Stackmint or its licensors. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law:
- Stackmint will not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 12 months before the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless Stackmint and its affiliates, officers, agents, and employees from any claims, damages, liabilities, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any rights of another.
12. Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms or applicable law. You may terminate your account at any time by contacting legal@stackmint.ai.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Services before the changes take effect. Your continued use of the Services constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
