Stackmint Terms of Service

1. Overview of Stackmint

Stackmint is a platform that enables users to create, deploy, and share AI-powered applications, workflows, and integrations ("Buds" and "Branches") from prompts.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement.

3. Accounts and Security

Account creation: You must provide accurate and complete information when creating an account.

Security: You are responsible for safeguarding your account credentials and for all activities under your account.

Notification: Notify us immediately at legal@stackmint.ai if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

• —Infringe on the intellectual property or rights of others.
• —Upload malicious code or interfere with the operation of the Services.

Ownership: You retain ownership of any content you create or upload using the Services.

License to Stackmint: By submitting content, you grant Stackmint a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display that content solely to operate and improve the Services.

Responsibility: You are responsible for the legality, reliability, and appropriateness of your content.

6. Third-Party Services

The Services may integrate with third-party applications (e.g., Salesforce, Slack, Google Calendar). Your use of those services is governed by their own terms, and you are responsible for reviewing them.

7. Payment and Subscriptions

Fees: Some Services require payment of fees, which will be disclosed before you purchase.

Billing: By providing payment information, you authorize us (and our payment processors) to charge the applicable fees.

Cancellation: You may cancel subscriptions at any time; charges already incurred are non-refundable unless otherwise stated.

8. Intellectual Property

All rights, title, and interest in the Services (excluding your content and third-party content) are owned by Stackmint or its licensors. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law:

• —Stackmint will not be liable for any indirect, incidental, special, consequential, or punitive damages.
• —Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Stackmint and its affiliates, officers, agents, and employees from any claims, damages, liabilities, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any rights of another.

12. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms or applicable law. You may terminate your account at any time by contacting legal@stackmint.ai.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Services before the changes take effect. Your continued use of the Services constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

15. Stackmint SMS Terms of Service

Program Name: Stackmint Notifications

Program Description: By opting in, you agree to receive transactional and operational SMS messages from Stackmint related to your account activity, workflows, and system events. These messages include execution alerts, reminders, and status updates triggered by your configured workflows.

Message Frequency: Message frequency varies based on your activity and configured workflows.

Message and Data Rates: Message and data rates may apply depending on your mobile carrier plan.

Opt-Out Instructions: You can opt out at any time by replying STOP to any message. You will no longer receive SMS notifications after opting out.

Consent: SMS notifications are only sent after explicit user opt-in via account settings or workflow configuration.
